Terms and Conditions

1. Scope

These Terms & Conditions apply to all services, products, offers, and purchases provided by Form Furniture (“we”, “us”, “our”) through this website, our showrooms, or via direct communication.

2. Products and Services

We provide furniture, kitchen, lighting, and related interior solutions as described on our website, in our showrooms, or agreed individually with clients.

The exact scope, product specifications, delivery details, installation services, and pricing are defined in an offer, invoice, purchase order, or written agreement.

3. Contract Formation

A contract is concluded when an offer is accepted in writing, by email, through direct confirmation, or when an order is confirmed and processed by mutual agreement.

4. Prices and Payment

  • Prices are stated or agreed individually depending on the selected products, services, delivery, and installation requirements.
  • Invoices are payable within the agreed payment period unless otherwise stated in writing.
  • For custom orders or larger projects, advance payments or staged payments may be required.
  • In case of late payment, we reserve the right to charge reminder fees and/or statutory interest and to pause delivery or services until payment is received.

5. Client Obligations

The client agrees to:

  • Provide accurate contact, delivery, and project information.
  • Review and approve product specifications, measurements, materials, colors, and finishes before confirmation.
  • Ensure that access to the delivery or installation location is available when required.
  • Cooperate as required to enable proper delivery, installation, or project completion.

6. Delivery Times and Delays

Delivery dates are estimates unless explicitly agreed as binding.

Delays caused by missing client feedback, incomplete information, supplier delays, transportation issues, customs procedures, third-party providers, or force majeure do not constitute a breach of contract.

7. Returns and Custom Orders

Returns, exchanges, or cancellations are handled according to the agreed terms and applicable law.

Custom-made products, special orders, customized furniture, kitchens, lighting solutions, or products ordered according to individual client specifications may not be eligible for return or cancellation unless defective or otherwise required by law.

8. Warranty and Defects

The client must inspect delivered products upon receipt and notify us of any visible defects within a reasonable time.

Warranty claims are handled according to applicable law, manufacturer conditions, and the specific product or service agreement.

Damage caused by improper use, incorrect maintenance, unauthorized modifications, normal wear and tear, or external factors is excluded from warranty coverage.

9. Liability

We are liable only for damages caused by intentional misconduct or gross negligence, to the extent permitted by applicable law.

We are not liable for indirect damages, loss of profit, delays caused by third parties, or consequential damages.

10. Intellectual Property

All concepts, layouts, visual materials, product presentations, designs, drawings, and documents created or provided by Form Furniture remain our intellectual property unless otherwise agreed in writing.

Any reproduction, distribution, or commercial use without written permission is prohibited.

11. Confidentiality

Both parties agree to treat confidential information as strictly confidential and to use it only for the purpose of fulfilling the contract.

This obligation remains in effect after the end of the contractual relationship.

12. Third-Party Products and Services

If third-party products or services are used, such as suppliers, manufacturers, delivery companies, installation partners, or technical service providers, the client may be subject to the terms of those providers.

We are not responsible for delays, changes, or failures caused by third-party providers beyond our control.

13. Termination

Either party may terminate ongoing agreements according to the conditions agreed in writing.

Products already ordered, work already performed, custom production, delivery costs, or installation services must be paid according to the agreed terms.

14. Governing Law and Jurisdiction

These Terms are governed by applicable law.

Place of jurisdiction is the competent court at the registered or operational place of business of Form Furniture, unless mandatory legal provisions provide otherwise.
